| Boies firm joins government's False Claims Act case against

| David Boies, Chairman of Boies, Schiller & Flexner
LLP, announced today that his firm has agreed to represent
one of the relators in the United States' Federal False Claims
Act lawsuit against Medco Health Solutions Inc. The Government
intervened in the action and filed its own Complaint on September
29, 2003. The lawsuit alleges that Medco submitted thousands
of false claims to employee health benefits programs, cancelled
and deleted patient prescriptions, shorted prescriptions, improperly
induced physicians to switch prescriptions and engaged in various
other illegal schemes to maximize profits at the expense of
the Government and individual patients. The action will be
handled by David Stone, the Administrative Partner of Mr. Boies'
New Jersey Office who has extensive experience in litigating
False Claim Act cases. "The exploitation of private and
public sources which provide prescription drugs to American
citizens is a serious problem which must be addressed now," Mr.
Boies said. "With the recent passage of federal legislation
requiring Medicare to provide wide coverage for most prescription
drugs, the issue is of increasing importance. Our firm intends
to be on the forefront of actions such as this, which can have
a tremendous impact on health care costs in the United States." The
Government's intervention in a False Claims Act case generally
follows an extensive investigation. The action is being handled
by James G. Sheehan of the United States Attorney's Office
for the Eastern District of Pennsylvania. |
