FCPA Whistleblower Practice

Stone & Magnanini represents whistleblowers who report violations of the Foreign Corrupt Practices Act (“FCPA”) to the SEC under the SEC Whistleblower Program. Working together with the whistleblower, the Firm drafts detailed reports outlining the FCPA violations and prepares a presentation for high level officers in the SEC, assisting the Commission’s understanding of the allegations and persuading it to bring the case. Stone & Magnanini has experience litigating cases that implicate the FCPA and understands the complicated and sensitive issues that are presented by violations of its provisions.

Unlike the False Claims Act, submissions of the FCPA do not need to be filed in federal court, but are reported to the SEC directly, a governmental agency flooded with dozens of similar complaints each day. Thus, it is important for whistleblowers to align themselves with experienced, knowledgeable professionals who recognize and understand both the advantages and the pitfalls of this challenging process.
